High Court To Rule On Amount Of Damages Payable To Shafie Apdal

KOTA KINABALU: The High Court is expected to rule on Wednesday (Nov 28, 2018) afternoon, the compensation for Datuk Seri Panglima Haji Mohd Shafie Apdal who filed a suit against Semporna lawyer Ainal Fattah for malicious prosecution.

The Semporna lawyer-politician had published in the media his application to bar the Parti Warisan Sabah President from contesting or voting in the recent 14th general election.

It is learned that High Court will rule on the assessment of what amount of damages are to be paid by Ainal to Shafie, who is now Sabah Chief Minister.

Shafie his suit filed at the Kota Kinabalu High Court in April this year claiming that that Ainal, either personally or through his counsel, had made public the application, highlighting alleged corruption in leading newspapers, with intent at causing maximum damage to his (Shafie’s) reputation as a well-respected politician.

The conduct of the defendant as outlined shows that he had acted deliberately to cause harm and damage to the plaintiff even though his application is unsustainable, frivolous and vexatious, as well as an abuse of the process of the court.
